Our Services are provided “AS IS.” and “AS AVAILABLE” basis. NFDC and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither NFDC, nor its suppliers and licensors, makes any warranty that our website/services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our website/services at your own discretion and risk. NFDC can take all reasonable precautions and put into place sufficient security measures to protect your personal data but cannot guarantee that no breach will take place.
Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our website/services will be governed by the laws of India.
The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our website/services will be the courts located in Delhi.
CHANGES
NFDC reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

This statement governs our privacy policies with respect to those users of the Site ("Visitors") who visit without logging in and Visitors who are registered Members ("Authorized Users") and log in to avail the various services/ content offered by Navy Foundation Delhi Charter (NFDC) (collectively, "Services") .
"PERSONALLY IDENTIFIABLE INFORMATION"
refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, Aadhaar number, PAN number and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.
WHAT PERSONALLY IDENTIFIABLE INFORMATION IS COLLECTED
We may collect basic user profile information from all of our Visitors. We collect the following additional information from our Authorized Users: the names, ranks, PNo, decorations, date of birth, date of commission, date of retirement, ashore and afloat appointments, addresses, phone numbers and email addresses of Authorized Customers and their spouses/ NOKs.
WHICH ORGANISATIONS ARE COLLECTING THE INFORMATION?
Other than our direct collection of information, some information may be shared with/ obtained from third parties like the Directorate of Naval Veterans, NAVPEN, NPO and PCDA (Pensions), Allahabad for the purpose of synchronising our database of Naval veterans and/ or pursuing pension/ entitlement cases of Naval veterans etc. We do not control how these third-parties use such information, but we do ask them to disclose how they use personal information provided to them from Authorized Users. Some of these third parties may be intermediaries that act solely as links in the distribution chain, and do not store, retain, or use the information given to them.
HOW DOES THE SITE USE PERSONALLY IDENTIFIABLE INFORMATION?
We use Personally Identifiable Information to customize the Site, to make appropriate service offerings, and to allow Naval veterans to find and contact old ship-mates/ course-mates/ acquaintances. We may email Authorized Users regarding their logging-in, change of password or other such activities/ interaction with the website. We may also use Personally Identifiable Information to contact Authorized Users in response to specific inquiries, or to provide requested information.
WITH WHOM MAY THE INFORMATION BE SHARED?
Personally Identifiable Information about Authorized Users may be shared with other Authorized Users for the purpose of facilitating them in contacting ship-mates/ course-mates/ acquaintances . We may share aggregated information about our Visitors and Authorized Users, including the demographics of our Visitors and Authorized Users, with agencies of the Indian Navy and/or authorised Indian Law Enforcement agencies, if called upon to do so to comply with the laws in force in India .
HOW IS PERSONALLY IDENTIFIABLE INFORMATION STORED?
Personally Identifiable Information collected by NFDC is securely stored and is not accessible to third parties or employees of NFDC except for use as indicated above.
What choices are available to Visitors regarding collection, use and distribution of the information?
Authorized Users may opt out of receiving unsolicited information from or being contacted by us and/or third-parties/ agencies by responding to emails as instructed, or by contacting us at Room No. 415 & 416, INS India, Defence Offices Complex, Africa Avenue, New Delhi – 110010”.
ARE COOKIES USED ON THE SITE?
Cookies are used for a variety of reasons. We use Cookies to obtain information about the preferences of our Visitors and the services they select. We also use Cookies for security purposes to protect our Authorized Users. HOW DOES NFDC USE LOGIN INFORMATION?
NFDC uses login information, including, but not limited to, IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user's movement and use, and gather broad demographic information.
WHAT PARTNERS OR SERVICE PROVIDERS HAVE ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION FROM VISITORS AND/OR AUTHORISED USERS ON THE SITE?
NFDC has NOT entered into any partnerships and other affiliations with any vendors. However, NFDC is required to share some PII, on a strictly need-to-know basis, with Indian Naval agencies like the Directorate of Naval Veterans, NPO, NAVPEN, PCDA (Pensions) in order to synchronise our database of Members and/or pursue cases for pension/ entitlements of Naval veterans. Our privacy policy does not cover the collection or use of this information by these third-parties.
DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION TO COMPLY WITH THE LAW.
We will disclose Personally Identifiable Information in order to comply with a court order or a request from a law enforcement agency to release information. We will also disclose Personally Identifiable Information when reasonably necessary to protect the safety of our Visitors and Authorized Users.
HOW DOES THE SITE KEEP PERSONALLY IDENTIFIABLE INFORMATION SECURE?
All of our employees are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors and Authorized Users is only accessible to a very limited number of qualified employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. Authorized Users may use the "Update Your Details" form (available after logging-in) to update Personally Identifiable Information about them or to correct any inaccuracies by emailing us at navyfoundationdelhicharter@gmail.com.
CAN A VISITOR DELETE OR DEACTIVATE PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY THE SITE?
We provide Authorized Users with a mechanism to delete/deactivate Personally Identifiable Information from the Site's database by contacting . However, because of backups and records of deletions, it may be impossible to delete a Visitor's entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.
WHAT HAPPENS IF THE PRIVACY POLICY CHANGES?
We will let our Visitors and Authorized Users know about changes to our privacy policy by posting such changes on the Site. However, if we are changing our privacy policy in a manner that might cause disclosure of Personally Identifiable Information that a Authorized User has previously requested not be disclosed, we will contact such Authorized User to allow such Authorized User to prevent such disclosure.
